These Terms of Service (“Terms”) govern your access to and use of the Beyond Urban platform (the “Platform”) and booking system provided by Beyond Urban AB, Eyvind Johnsons gata 4, 112 16 Stockholm. By accessing or using our Platform, you agree to comply with these Terms. If you do not agree, please refrain from using our services.

1. Scope of Service

Beyond Urban acts as an intermediary connecting customers with Partners who provide accommodations, tours, activities, and other travel-related services (“Services”). When you make a booking through Beyond Urban, you enter into a direct contractual relationship with the service partner (“Partner”). Beyond Urban does not own, manage, or provide the Services directly but facilitates the booking process and customer support as needed. Beyond Urban reserves the right to discontinue its website at any time.

2. Service Content and Categories

All information about a tour, accommodation or activity and its description on the Beyond Urban platform is based on the Partner’s own assessment. All content displayed on the platform is provided by the respective Partner, and Beyond Urban acts solely as a content provider. Hence, Beyond Urban is not responsible for any inaccuracies, omissions or typographical errors related to the service. Any classifications or ratings shown on Beyond Urban’s platforms serve as general indicators of a Partner’s standard, based on the Partner’s own assessment.

3. Bookings and Payments

  • Booking/Contract: All bookings are subject to availability and confirmation by the Partner. A booking is only confirmed once you receive a confirmation email from Beyond Urban, who acts as a carrier of the message. Once the booking is confirmed with a booking reference number, a binding contract comes into effect between you and the Partner of the chosen service. Beyond Urban acts as an independent third party and does not enter into the contract with you and the Partner. Beyond Urban shall not be a partner, trustee, representative or sub-contractor either for you or the Partner. Further, the Partner shall not be a sub-contractor or vicarious agent of Beyond Urban.
  • Payment Terms: Payments are processed securely through our Platform and the confirmed price is paid directly to the Partner. Depending on the Partner’s policies, you may be required to pay in full or provide a deposit at the time of booking. Any claims and obligations out of the contract only exist between you and the Partner of the chosen service. 
  • Prices: All prices displayed on the Platform have been provided by the Partner, where Beyond Urban acts as a content provider for the Partner only, and is thus not responsible for any errors of prices referring to a Partner. All prices displayed are current and shown in the name of the individual Service, and are valid for all bookings made via the booking system provided by Beyond Urban. 
  • Fees and Taxes: Additional charges, such as local taxes or service fees, may apply. These will be disclosed during the booking process.
  • Exchange Rates: Please be advised Converted rates using the website currency converter are based on an estimation of that days exchange rate.
  • Offers: Beyond Urban and Partner’s reserve the right to discontinue any offers at any time. Rates available and any booking made via the Beyond Urban booking system can’t be combined with other offers or promotions. Obvious errors and mistakes (including misprints) are not binding.

4. Cancellations and Refunds

  • Partner Policies: Cancellation terms vary by Partner and will be outlined during the booking process. It is your responsibility to review these terms before confirming your booking. 
  • No-Show Policy: If you fail to show up for your booking without prior notice, any refund or rescheduling will depend on the Partner’s policy.
  • Refund Processing: Beyond Urban will assist in facilitating refunds where applicable but is not liable for delays or disputes regarding refund amounts or timelines.

5. Responsibilities and Obligations

  • Customer Responsibilities:
    • Ensure all booking information is accurate and complete.
    • Abide by the Partner’s booking policies, rules and any applicable local regulations.
  • Beyond Urban Responsibilities:
    • Provide accurate information based on details received from Partners.
    • Facilitate secure transactions and offer customer support for any issues related to bookings. However, Beyond Urban is not responsible for any claims and obligations out of the contract between the customer and the Partner.

6. Liability Disclaimer

Beyond Urban is not liable for:

  • The availability, quality, or condition of the Services provided by the Partner.
  • Any injury, loss, or damages incurred during your travel experience.
  • Errors or inaccuracies in the Partner’s information.

7. Privacy and Data Protection

Your personal information is handled in accordance with our [Privacy Policy], which outlines how we collect, use, and protect your data.

8. Governing Law and Place of Jurisdiction

The laws of Sweden shall exclusively govern all legal relations between you and Beyond Urban. If you are acting as a consumer and have entered into a contract while residing in another country, nothing in this agreement shall affect the application of mandatory consumer protection laws of the country in which you reside.

In the case where you are a business or a public law entity, the courts in Stockholm shall have exclusive jurisdiction for any disputes arising from this agreement. However, Beyond Urban reserves the right to bring legal action against you at your general jurisdiction.

9. Modification Clause

Beyond Urban reserves the right to update these Terms at any time. Customers will be notified of significant changes, and continued use of the Platform constitutes acceptance of the updated Terms. The invalidity or unenforceability of any of these Terms and Conditions shall not affect, impair or invalidate any of the remaining terms and conditions.
